1. Who these terms apply to
These terms apply to anyone using this website and to clients engaging MakeItScale for services, including marketing management, paid advertising, email marketing, website design and development, automations, systems work and AI-generated content. By using the site or engaging us, you accept these terms.
2. Services and scope
Every engagement is defined by the scope agreed with you in writing (proposal, quote, email or message). Anything outside that scope is new work and quoted separately. We deliver what is agreed, on the timeline agreed, subject to you providing the access, content and approvals we need to do the work.
3. No guaranteed results
We are strict about following the data and our strategies are built on formulas we have refined across real campaigns. However, marketing outcomes depend on factors outside any provider's control, including your market, your offer, platform changes and ad approval decisions. We do not guarantee specific revenue, lead volume, rankings or ad performance, and nothing on this site or in our proposals should be read as a guarantee.
4. Quotes, payment and late payment
- Quotes are valid for 30 days unless stated otherwise.
- Invoices are payable by the due date shown on the invoice.
- Ad spend is paid by you directly to the platform (for example Meta or Google) and is separate from our fees.
- We may pause work on overdue accounts until payment is received.
5. Your obligations
You agree to provide accurate information, timely feedback and the platform access needed to deliver the work, and to hold the legal rights to any content, branding or product imagery you supply to us.
6. Intellectual property
Once an invoice is paid in full, the deliverables created for you under that engagement are yours. We retain ownership of our internal tools, processes, templates and know-how used to produce the work, and we may display completed work in our portfolio unless you ask us not to in writing.
7. AI-generated content
Some deliverables, including product imagery and on-model fashion imagery, are produced using AI tools. We review AI output before delivery, but you are responsible for final approval before it is published. Where a platform requires AI content to be disclosed, that disclosure is your responsibility once the content is in your hands.
8. Third-party platforms
Our work often runs on platforms we do not control, including Meta, Google, Shopify, Klaviyo and hosting providers. We are not responsible for outages, policy changes, account restrictions or data loss caused by those platforms.
9. Liability
To the extent permitted by law, our total liability for any claim arising out of an engagement is limited to the amount you paid us for the specific work the claim relates to. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
10. Termination
Either party may end an ongoing engagement with 14 days' written notice. Work completed up to the end date is payable. Deposits for project work are non-refundable once work has started, as they cover work already performed.
11. Governing law
These terms are governed by the laws of Queensland, Australia, and any dispute falls under the jurisdiction of the courts of Queensland.
12. Changes to these terms
We may update these terms from time to time. The version published on this page applies from its effective date. Material changes to an active engagement will be agreed with you directly, not imposed by a website update.
Privacy Policy
Effective 12 June 2026
MakeItScale complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy explains what we collect, why, and how to reach us about it.
1. What we collect
- Forms and audits: business name, your name, email, phone, website URL, Instagram handle and the answers you give in our audit questionnaires.
- Bookings: your name, contact details and the time you book.
- Client work: the access and account information needed to deliver the agreed services.
- Site usage: standard technical data such as browser type and pages visited, where analytics are enabled.
2. Why we collect it
To respond to your enquiry, prepare your audit, deliver the services you engage us for, manage bookings and invoices, and contact you about work that is relevant to you. We do not sell personal information to anyone.
3. Where it is stored
Information submitted through this site is stored with reputable third-party processors, including our database and email providers, which may store data outside Australia. We limit access to people who need it to do the work.
4. Marketing communications
If we email you beyond responding to your enquiry, every message includes a way to opt out, consistent with the Spam Act 2003 (Cth). Opting out stops marketing messages; it does not stop messages we need to send about active work.
5. Access, correction and deletion
You can ask for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Email info@makeitscale.com.au and we will action it within a reasonable time, subject to records we are legally required to keep.
6. Complaints
If you believe we have mishandled your information, contact us first and we will work to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
